The Billion-Rand Question: Do Liabilities Simply Disappear?
In 2022, a significant legal and accounting battle unfolded in the Gauteng High Court. The Road Accident Fund (RAF) sought to prevent the Auditor-General (AG) from making its annual audit report public, pending a review of the AG’s findings. At the heart of the dispute was a change in accounting policy that effectively saw billions of rands in liabilities “disappear” from the balance sheet.
The Auditor-General’s stance was clear: Substance must always prevail over form. In professional reporting, a balance sheet must reflect the true economic reality of an entity, regardless of the legal or administrative “form” it tries to adopt.
The Integrity of Policy Changes
Accounting standards are not tools for social engineering or financial optics. According to established frameworks (including GRAP and IFRS), an entity should change an accounting policy ONLY under two conditions:
- The change is required by an accounting standard.
- The change results in financial statements providing more reliable and relevant information about the effects of transactions on the entity’s financial position.
An accounting policy change is never a valid mechanism to hide mismanagement, mask unsustainable practices, or “save” a balance sheet from technical bankruptcy.
The High Cost of Courtroom Accounting
The trend of state entities attempting to resolve technical accounting challenges through litigation rather than compliance is a growing concern for governance structures. When the “numbers don’t look good,” the solution is strategic remediation and technical accuracy—not a court order to silence the auditor.
